Prenuptial Agreements

Peterson Goodman & Hawkins PLC can assist with preparing a prenuptial agreement. A prenuptial agreement—or premarital agreement—is a contract between a couple planning to marry to determine how assets, debts, and other issues will be resolved if the marriage does not work out or upon the death of a spouse. Prenuptial agreements are hardly a romantic topic and many couples forego creating one, only to regret it later.

A prenuptial agreement could be considered a form of insurance against unforeseen circumstances. Having car insurance does not imply that you plan to have a car accident, just as having health insurance does not mean that you expect to break a leg. Nevertheless, as everybody knows, accidents— or divorces—do happen and anticipating them can protect you financially.

At Peterson Goodman & Hawkins PLC, we will explain your options and work with your fiancé’s lawyer to produce an equitable agreement that both parties are comfortable signing. In addition to prenuptial agreements, we also offer a range of estate planning services.

What does a prenuptial agreement do?

At Peterson Goodman & Hawkins PLC, we draft prenuptial agreements that acknowledge and anticipate various circumstances depending on the needs of the couple:

  • Division upon divorce of real estate, bank accounts, and investments, whether brought into the marriage or acquired during the marriage.
  • Payment of spousal support
  • Liability for payment of debts
  • Rights to inherit upon the death of the other spouse
